Is buying off-plan property in Bulgaria worth the risk in 2024?

I am currently looking into purchasing an off-plan apartment in a new development near Varna for investment purposes. While the lower entry price is very attractive, I am worried about potential construction delays or the developer going bankrupt before completion. Has anyone here had experience with Bulgarian developers, and what legal safeguards should I prioritize during the contract phase? I would appreciate any advice on whether the potential capital appreciation outweighs these inherent risks.

I bought off-plan in Varna three years ago. It was a stressful experience because the completion date was pushed back by nine months, but the capital appreciation was worth it in the end. My advice: hire an independent lawyer who doesn't work for the developer.

The risk is real. Many developers in Bulgaria rely on cash flow from new buyers to finish older projects. Before you sign anything, check if they have a history of completed projects and ask for bank guarantees.

Never pay the full amount upfront. Negotiate a payment schedule linked to specific construction milestones, like 'Act 14' (rough construction) and 'Act 15'. If the developer refuses this, walk away.

I lost a deposit on a project in 2021 when the developer went insolvent. It took two years to get half of it back through the courts. It's a gamble, so ensure you have a penalty clause for delays written into the preliminary contract.

Don't forget to factor in the secondary costs that people often overlook. You can find a breakdown of the
hidden costs of buying property in Bulgaria here, which might change your ROI calculation significantly.

Is it worth it? Honestly, in 2024, the market in Varna is quite saturated. Unless you are getting a significant discount for buying early, the risk-to-reward ratio for off-plan might not be as attractive as it was five years ago.

Make sure your contract is notarized and registered at the Registry Agency. This gives you a much stronger legal standing if the developer tries to sell the same apartment to someone else or goes bankrupt.

I work in construction in the Varna region. My tip: visit the site personally once a month. If you see construction activity slowing down, press the developer immediately. Do not rely on email updates.

The legal framework in Bulgaria has improved, but you must prioritize a 'preliminary contract' that clearly outlines the building specifications and materials. Developers often try to downgrade finishing materials to save money.

For investment purposes, have you considered how much the annual maintenance fees will be? Some new luxury complexes have sky-high charges that eat into your rental yields. Always ask for a draft of the management contract before signing.

I think off-plan is only worth it if you have a local contact who knows the reputation of the developer. If you are an outsider, you are an easy target for delays and contract tricks.
